Being a patch member of the Mongrel Mob isn't illegal but it just so happens that their activities are breaking the law. In reality they are no different from any other outfit running organised crime. However, Eve allows in-game crime.
Basically if people are getting upset about posting and propaganda in CAOD they are really reading the wrong section of the forums. Consider yourself lucky that only a minority of the 5400 GS members post in CAOD otherwise it would be impossible to read.

I'm not going to tell you what Goonswarm is, I'll leave that to the Goons, but a coherent regimented group ruled by an iron fist they are not.
Of course I don't want to directly compare GoonSwarm to ****s. However, GoonSwarm is not as simple as being a member of an ethnic community.
Its a group of like minded people from a third part website that choose to be members of an organization to advance common goals in this MMO. In the past, I've heard it as to believe it out of the mouth of the goonies themselves (go visit the SA forums some time) that this goal (though it has changed a couple of times) was the smashing of the EvE community and material harm to CCP.
So, like the ****s, because you aren't born a **** you choose to be one, just like you aren't born a goonie, you choose to be one, GoonSwarm represents an organization around a CHOSEN set of goals.
As for GoonSwarm not being hierarchical, give me a break. I suppose the alliance has just challenged the strongest 0.0 alliance while claiming large swaths of 0.0 space purely by accident. It was all blind chance. Every victory they've had, every PoS they put up completely random. 
In fact, I'm sure that Goonies just hit random keys while logged into eve but somehow manage to fly/fight/post together while playing this game.
